These Terms of Service ("Terms") form a binding agreement between you and Vestige2Go, Inc. ("Vestige2Go," "we," "us," or "our"). By accessing or using our website, creating an account, launching a campaign, or submitting information or payment through Vestige2Go, you agree to these Terms and our Privacy Policy.
If you use Vestige2Go on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
1. Agreement to these terms
Please read these Terms carefully before using Vestige2Go. If you do not agree, do not access or use the platform.
Additional terms may apply to specific campaigns, checkout flows, onboarding steps, or event-specific pages. Where those terms conflict with these Terms for a particular transaction, the more specific terms may govern that transaction.
2. Our services
Vestige2Go provides a cloud-based platform for nonprofit and community fundraising campaign operations. Services may include:
- Portal accounts and team access for campaign administrators
- Fundraising campaign setup, configuration, and workflow management
- Ad submission intake, sponsorship pages, and patron listing tools
- Souvenir journal campaign workflows and closeout reporting
- Stripe-powered checkout, payment records, and campaign reconciliation tools
- Upload and storage of campaign materials and production assets
- Dashboards, exports, notifications, and operational reporting
We may add, modify, suspend, or discontinue features over time as we improve the platform. We will use reasonable efforts to avoid material disruption to active campaign operations, but uninterrupted availability is not guaranteed.
3. Accounts and eligibility
To access certain features, you must create a portal account or complete onboarding. You agree to provide accurate, current information and to keep account credentials confidential.
You are responsible for all activity that occurs under your account, including actions taken by authorized team members. Notify us promptly if you suspect unauthorized access.
You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account or enter into these Terms on your own behalf.
4. Organizer responsibilities
If you use Vestige2Go to operate a fundraising campaign, you are responsible for:
- Accurate campaign descriptions, pricing, deadlines, and published terms for your event
- Obtaining any permissions needed to collect contributions, publish names, or use submitted materials
- Reviewing ad submissions, sponsorship details, and uploaded files before production or publication
- Complying with applicable nonprofit, fundraising, tax, and consumer protection laws
- Handling donor or contributor communications related to your specific event where appropriate
- Maintaining appropriate internal controls over who can access campaign data in your portal
Vestige2Go provides operational software. Unless expressly agreed in writing, we do not act as the fundraiser of record for your event and do not provide legal, tax, or accounting advice.
5. Contributor submissions
Patrons, sponsors, advertisers, and other contributors who submit information or complete checkout through a Vestige2Go campaign page agree that:
- Submitted names, messages, selections, and uploaded files may be used by the organizing campaign for journal production, event programs, recognition listings, and related fulfillment
- They will review checkout details carefully before payment
- They have the right to submit the content they provide
Campaign-specific checkout terms may apply to individual purchases or submissions, including production timelines and final-sale policies once materials enter workflow.
6. Fees, billing, and refunds
Vestige2Go subscription plans, campaign fees, and related pricing are described on our website, in onboarding, or in an order form or written agreement. Fees may be billed on a recurring or event-based basis depending on your selected plan.
Unless otherwise stated in writing, fees paid to Vestige2Go for platform access or services are non-refundable once billing begins or services are delivered. We may change pricing for future billing periods with reasonable notice where required.
Contributions, sponsorships, ad purchases, and similar payments made through a campaign checkout page are generally final once submitted, because submissions may immediately enter production, reporting, or event preparation workflows. Refund decisions for those transactions are typically handled by the organizing campaign unless otherwise stated at checkout.
7. Payment processing
Online payments are processed through Stripe. Your use of Stripe checkout is subject to Stripe's terms and policies. Vestige2Go is not a bank, money transmitter, or card network.
We are not responsible for Stripe outages, payment declines, chargebacks, or account holds managed by Stripe or financial institutions, though we will use reasonable efforts to support transaction visibility and reporting within the platform.
Stripe's services are governed by Stripe's own terms, available at stripe.com/legal.
8. Acceptable use
You agree not to misuse Vestige2Go. Prohibited conduct includes:
- Violating applicable law or third-party rights
- Uploading unlawful, infringing, deceptive, or harmful content
- Attempting to gain unauthorized access to accounts, systems, or data
- Interfering with platform security, performance, or other users
- Using the platform for fraudulent fundraising or misrepresentation
- Scraping, reverse engineering, or copying the service except as permitted by law
- Reselling or sublicensing the platform without our written consent
We may investigate suspected violations and suspend or terminate access where appropriate.
9. Intellectual property
Vestige2Go and its licensors own the platform, software, branding, documentation, design, and related intellectual property, excluding Customer Content defined below.
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable right to access and use the platform for your internal campaign operations during the term of your account or agreement.
10. Customer content
"Customer Content" means materials you or your contributors upload or submit through Vestige2Go, including advertisement files, logos, copy, patron names, sponsorship details, and campaign records.
You retain ownership of Customer Content. You grant Vestige2Go a non-exclusive, worldwide license to host, reproduce, process, display, and use Customer Content solely to provide, secure, and improve the services, fulfill campaign workflows, and support reporting for authorized users.
You represent that you have the rights necessary to submit Customer Content and that its use through Vestige2Go will not violate law or third-party rights.
11. Third-party services
The platform may integrate with or link to third-party services such as Stripe, email providers, calendar tools, or hosting infrastructure. We do not control third-party services and are not responsible for their acts or omissions.
Your use of third-party services is governed by the applicable third-party terms and privacy policies.
12. Disclaimers
Vestige2Go is provided on an "as is" and "as available" basis to the fullest extent permitted by law. We disclaim all warranties, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the platform will be uninterrupted, error-free, or free from harmful components, or that campaign results, fundraising totals, or production outcomes will meet your expectations.
13. Limitation of liability
To the fullest extent permitted by law, Vestige2Go and its officers, directors, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business interruption, arising out of or related to the platform or these Terms.
To the fullest extent permitted by law, our total liability for any claim arising out of or relating to the platform or these Terms will not exceed the greater of (a) the amount you paid to Vestige2Go for the services giving rise to the claim during the twelve (12) months before the event giving rise to liability, or (b) one hundred U.S. dollars (USD $100).
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
14. Indemnification
You agree to defend, indemnify, and hold harmless Vestige2Go from and against claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the platform, your Customer Content, your campaign operations, your violation of these Terms, or your violation of applicable law or third-party rights.
15. Termination
You may stop using Vestige2Go at any time. We may suspend or terminate access if you violate these Terms, create risk for us or other users, or where required by law or payment provider rules.
Upon termination, your right to access the platform ends. Provisions that by their nature should survive termination will survive, including payment obligations, intellectual property terms, disclaimers, limitations of liability, and indemnification.
16. Changes to these terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above and may provide additional notice for material changes where appropriate.
Continued use of Vestige2Go after updated Terms become effective constitutes acceptance of the revised Terms, except where additional consent is required by law.
